Terms of Service
These Terms of Service ("Terms") govern your use of the PULSE1 mobile application and the giladenterprises websites (together, the "Services"), operated by Gilad Enterprises ("we," "us," or "our"). By downloading, accessing, or using the Services you agree to these Terms.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial entertainment on Apple-branded devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.
2. Acceptable use
- Do not reverse-engineer, decompile, or modify the App except as permitted by law;
- Do not interfere with the operation of the Services, including the advertising they display;
- Do not generate fraudulent or invalid ad impressions or clicks;
- Do not use cheats, automation, or exploits to manipulate scores or leaderboards.
3. Advertising
The App is free to play and is funded entirely by advertising served by Google. Ads are part of the Service, and you agree that we may display them within the App. We are not responsible for the content of third-party advertisements or for the products and services they promote.
4. Virtual items
Sparks, cosmetic trails, tier progress, and other in-game items have no monetary value, cannot be purchased or redeemed for money, and may be modified or reset at our discretion. The App contains no in-app purchases.
5. Leaderboards
Leaderboards are operated through Apple Game Center and the optional PULSE1 Top 100 service. If you post to PULSE1 Top 100, the display name you choose and your score may be shown publicly. Do not use offensive, impersonating, or personally sensitive names. We may reject or remove scores that we reasonably believe were obtained through cheating, automation, exploits, manipulation, or other abuse.
6. Intellectual property
The Services, including the PULSE1 name, design, code, artwork, and audio, are owned by Gilad Enterprises and protected by applicable intellectual-property laws. These Terms grant you no ownership rights.
7. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, Gilad Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed fifty U.S. dollars (US$50).
9. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms. You may stop using the Services at any time by deleting the App.
10. Changes
We may update these Terms from time to time. The current version will always be available at this URL with the effective date shown above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Gilad Enterprises operates, without regard to conflict-of-law principles.
